CAS 2015/A/4304 Tatyana Andrianova v. All-Russia Athletic Federation

In August 2015, the International Association of Athletics Federations (“IAAF”) re-analysed a urine sample collected from Ms Andrianova at the 2005 IAAF World Championships. The IAAF charged Ms Andrianova with the commission of an alleged anti-doping rule violation.

Ms Andrianova disputed both the accuracy of the analytical results and the fact that the action against her had been initiated outside of the then applicable Statute of Limitations. The All-Russia Athletic Federation (“ARAF”) dismissed Ms Andrianova’s defence and imposed a two-year ban on her.  ARAF also disqualified all results achieved by Ms Andrianova between 9 August 2005 and 8 August 2007.

Ms Andrianova appealed that decision to the Court of Arbitration for Sport (“CAS”). The CAS has announced today (14 April 2016) that it has upheld the appeal, confirming that the IAAF and ARAF were time-barred from opening disciplinary proceedings against Ms Andrianova. The ARAF decision is therefore annulled, the two-year ban is rescinded and all of Ms Andrianova’s results are reinstated.
